Показано, что на возникновение дискуссии о моральности пыток повлияли следующие факторы. Во-первых, впервые сформулированная дилемма «грязных рук», которая в аналитической традиции оказалась важнейшим инструментом анализа соотношения целей / средств. Во-вторых, создание такого теоретического и прикладного направления философских исследований как теория справедливой войны. Хотя и следует признать, что перенос эвристик справедливой войны как способ аргументации в пользу применения пыток оказался мыслительным тупиком, однако он позволил нащупать возможности и ограничения новых теоретических разработок в сфере моральной философии, что всегда является необходимым этапом для реитерации дебатов. </p></abstract><trans-abstract xml:lang="en"><p>The article reconstructs a brief period of intensive debates on the legitimacy and justification of torture in the early 1970s to the mid-1980s. It is shown that the emergence of the discourse on the morality of torture was influenced by the following factors. Firstly, the formulation of the “dirty hands” dilemma, which in the analytical tradition became a crucial tool for analyzing the relationship between ends and means. Secondly, the establishment of a theoretical and applied field of philosophical research known as the just war theory.
